Judge, Jury, & Executioner Acceptable Lifestyles . . . .



Two stories that ought to forever dispel the fanciful notion that American society is unquestioningly superior to any other nation's society in the world.

Story #1:
After two days of testimony in Hillsborough Circuit Court, a jury decided Wald committed no crime when he fatally shot Walter Conley, a man less than half his age, on March 10. Wald woke around midnight in his Brandon home and found Conley and Flores having sex on the floor in the living room. He took a .38 revolver from his bedroom and shot Conley in the stomach and head.

  • Man finds wife and lover in throes of consensual sex in his house
  • Wife's lover is shooter's next door neighbor and former employee
  • Deceased man has tattoo on back with shooter's wife's name in it
  • The deceased man was naked, unarmed and prone on floor when shot

And a jury of Wald's peers acquit him of murder charges based on Florida's "Stand Your Ground' law.




While you dear reader are mulling that bit of idiocy over, here's another story that will give Story #1 a competitive run for it's money in the lunacy department:

Story #2:
A jury in Bexar County, Texas just acquitted Ezekiel Gilbert of charges that he murdered a 23-year-old Craigslist escort—agreeing that because he was attempting to retrieve the $150 he'd paid to Lenora Ivie Frago, who wouldn't have sex with him, his actions were justified.
Gilbert had admitted to shooting Frago in the neck on Christmas Eve 2009, when she accepted $150 from Gilbert and left his home without having sex with him. Frago, who was paralyzed by the shooting, died several months later.
Gilbert's defense argued that the shooting wasn't meant to kill, and that Gilbert's actions were justified, because he believed that sex was included as part of the fee. Texas law allows people" to use deadly force to recover property during a nighttime theft."

Story #2 basic facts:

  • Shooter was in act of committing a crime (solicitation of prostitution)
  • Deceased woman was shot in neck, without warning
  • Deceased woman never physically attacked or threatened to attack shooter
  • Under Texas law, if shooting had occurred in daylight hours, it would not have been legal

And a jury of Gilbert's peers acquit him of murder charges because under Texas law, the shooting occurred under the moon and stars instead of a sunny, unclouded sky.


Sigh . . .

George Carlin used to quantify his harsh views toward U.S. society by saying that he loved America, it's just that the people are fucked.  The Gadfly has been a faithful adherent of that outlook for some time himself, but when he reads stories like this, it induces him to want to re-examine his unconditional love of his country as a standalone entity.

The Gadfly wishes President Obama would just end this stupid and cynical charade of faux outrage hot potato surrounding the NSA surveillance program:

Former Republican presidential candidate Mitt Romney said Hurricane Sandy -- a major storm that pummeled the East Coast in October 2012, just before Election Day -- "didn't come at the right time."
"I can tell you the hurricane didn't come at the right time," Romney told Fox News' Neil Cavuto on Friday.
Sandy caused 159 deaths and between $50 and $100 billion in damage.
"I wish the hurricane hadn’t have happened when it did, because it gave the President a chance to be presidential, and to be out showing sympathy for folks," Romney said. "That’s one of the advantages of incumbency.”

We dirty fucking hippies have been warning them for years about this shit coming down the pike. Warnings, of course that have mostly fallen on deaf ears - or more like ears full of fracking fluid and drilling waste.  The Gadfly would advise his dear readers to prepare for more and more stories like this in the years ahead:

Barnhart, a small community in West Texas, has run out of water.
John Nanny, an Irion County commissioner and an official with Barnhart’s water supply corporation, said on Thursday that the situation was serious. When reached by telephone, he was working on pumping operations and hoped to have a backup well in service Friday morning. A load of bottled water was on its way to the community center, he said.
The town has one main well that serves 112 customers, according to the Texas Commission on Environmental Quality. But the well stopped pumping quickly enough Tuesday evening, and while there is still some water in it, Nanny said, "We don’t want to get down to the mud."
Nanny said he had checked for a leak but had not found one. The Barnhart area has been hard-hit by drought, he said, just as surging oil and gas drilling activities have increased local water demands.

A Country's Collective Amnesia is Indeed Quite a Piteous Thing to Behold . . .

The Gadfly is not going to waste any of his precious life-force energy furrowing his brow and frantically searching out the nearest fainting couch over the NSA phone records data mining (now encompassing pretty much all of the social media outlets and the internet as a whole) outrage.

There is a very unpretentious reason why The Gadfly's views are so blandly mundane on this subject.  The Gadfly remembers quite clearly this little event occurring in the not too distant past of our dying democracy:

The USA PATRIOT Act of 2001 is an Act of the U.S. Congress that was signed into law by President George W. Bush on October 26, 2001. The title of the act is a ten letter acronym (USA PATRIOT) that stands for Uniting (and) Strengthening America (by) Providing Appropriate Tools Required (to) Intercept (and) Obstruct Terrorism Act of 2001.[1]
The act, as a response to the September 11 terrorist attacks of September 11th, significantly weakened restrictions on law enforcement agencies' gathering of intelligence within the United States; expanded the Secretary of the Treasury’s authority to regulate financial transactions, particularly those involving foreign individuals and entities; and broadened the discretion of law enforcement and immigration authorities in detaining and deporting immigrantssuspected of terrorism-related acts. Read that information again dear readers.  It took your government a grand total of 6 weeks after the 9/11 attacks to thoroughly and permanently shred the 4th amendment to the Constitution - you know - that quaint little section dealing with the ability of the government to perform unreasonable searches and seizures without judiciously sanctioned warrants and probable cause?  One might just as well throw the 1st amendment in to that shredding machine as well - due to the fact that journalists are being spied on and government whistleblowers are being jailed left and right.

Six weeks -- even before all of the tattered and bloodied remains of the World Trade Center tower's victims had been fully recovered -- that is how long it took your cowardly and foolish political leaders to drive the final nail into the coffin containing the dusty remnants of the founding father's dreams of a nation that was meant to be the beacon of man-made law and democratic principles for the whole world to emulate.

Hell -- our fractious politicians usually spend 6 months infighting among their own caucuses on major legislative issues before ever even creating actual bills to be sent up the chain.  And then even those bills are usually fought over with their political adversaries for another 6 months.  In the end 9 times out of 10 these bills die during the long, arduous legislative process.

Yup - 6 weeks folks - the amount of time it took for America to slit it's own democratic throat - all in a fit of timorous fear and panic.

The bottom line is - the Police-State train left the station on October 26, 2001 kids -- and it ain't coming back.  And while the predominance of culpability can be laid squarely at the feet of our gutless political rulers, it takes an equally gutless and supine citizenry to allow them to get away with it so effortlessly in the first place.

So that is why The Gadfly truly is not all that agitated about this shit.  In fact, The Gadfly will let a fellow blogger known as The Rude Pundit to put it all in to a crystalline perspective for you:

No president is ever going to give back the powers that were granted to George W. Bush in 2001. If you're scared that Obama has them, well, shit, a bunch of us warned you that Bush wasn't gonna be president forever. And even if the Patriot Act were, through some miracle, overturned in court or legislated out of existence, it's too late: the web of surveillance has been put in place. You can bet that its future legality has already been set up.
It is a frightening thought, yes, that our responsibility as citizens is not to try to reclaim our lost privacy. What revolution will accomplish that? It ain't gonna happen. It's sad, frustrating, enraging, and ultimately exhausting and enervating. That boat has sailed, and it ain't ever returning to port.
What we are left with is merely electing people who we believe will be wise shepherds of this power to invade our privacy whenever they wish in order to "protect us" from "terrorists" or the fake existential threats of the future. That is a sad reduction of democracy. That is the opposite of hope, no? Merely wanting to be led by people who won't harm us?

Enough Already . . . . Put This Unmercifully Beaten Dead Horse In The Grave Where it Belongs

Okay - can we finally put an ignominious end to this raging nonsense over the wholly manufactured, bullshit IRS "scandal?":

An analysis of a list of groups approved for tax exempt status, released by the Internal Revenue Service in the wake of its admission to targeting conservative groups for heightened scrutiny, determined that of the groups approved, more than two-thirds were conservative.
The analysis, by Martin A. Sullivan of Tax Analysts, examined a list of 176 advocacy organizations that were ultimately approved for tax exempt status by the IRS during the period when the service admits to having targeted certain conservative groups with inappropriate criteria.
According to Sullivan's analysis, 122 of the groups were conservative, 48 were liberal or non-conservative and 6 remain of unidentified ideology.

So - from all of the applications submitted by advocacy groups and approved for 501(c)4 tax exempt status by the IRS, a full 66% of them were conservative organizations.  Kind of undermines the "BWaaaaahh!!  The mean ol' IRS is pickin' on us" self-pity parade doesn't it?

The Gadfly knows that some of his conservative acquaintances, due mostly in part to the slick little Sean Hannity earworm in their cranial cavities egging them on, are going to shriek at him, "Hey Gadflop!  Explain then why the IRS was targeting only conservative Tea Party type organizations for tax-exempt status review and not liberal groups? Huh?  Huh??  Huh???"

Were there more conservative groups than liberal groups singled out for IRS review?  Absolutely. Why?  For the very mathematically deduced reason that conservative organizations constituted 70% of all the applications for tax exempt status under the 501(c)4 statute.  So - taking this to it's logical conclusion (ahh yes - the word that strikes fear in the heart of all conservatives - logical!), of course the total number of conservative applications scrutinized is going to be more.  It is the exact same logic that accounts for more conservative groups being approved for 501(c)4 status (read the Huffington Post article linked above).  Why, can someone explain to The Gadfly, is that so hard to fucking comprehend?

The Gadfly is fully cognizant of the fact that many conservatives have a real difficult time separating truth from fiction and logic from idiocy - so he will re-review this process in a very analytical, step-by-step, judicious method with them - mostly so as not to overload their already seriously defective logical thought processes.

Before The Gadfly begins his lesson - let's establish the one immutable fact that should, to any reasonably thinking individual, put this whole partisan circus side-show into the proper perspective.  Here is the law, word for word, as it pertains to what exactly is supposed to constitute a 501(c)4 organization, thus qualifying said organization to be exempt from federal government taxation:

The Statute IRC 501(c)(4) provides for exemption of:
Civic leagues or organizations not organized for profit but operated
exclusively for the promotion of social welfare.
Local associations of employees, the membership of which is limited to the
employees of a designated person or persons in a particular municipality
and the net earnings of which are devoted exclusively to charitable,
educational, or recreational purposes.
The statutory terms disclose that IRC 501(c)(4) embraces two general
classifications:
a. Social welfare organizations, and
b. Local associations of employees.

The Statute goes on to say:

Reg. 1. 501(c)(4)-1(a)(2)(i) provides that:
 [A]n organization is operated exclusively for the promotion of
social welfare if it is primarily engaged in promoting in some
way the common good and general welfare of the community
.


Obviously the language of both the statute and the regulations
comprehends a very broad category of organizations
. As stated in the
1981 CPE text, Chapter G, "Social Welfare: What Does It Mean? How
Much Private Benefit Is Permissible?"
Although the Service has been making an effort to refine
and clarify this area, IRC 501(c)(4) remains in some
degree a catch-all for presumptively beneficial non-profit
organizations that resist classification under the other
exempting provisions of the Code. Unfortunately, this
condition exists because "social welfare" is inherently an
abstruse concept that continues to defy precise definition.
The general concept, however, can be expressed as follows:
Organizations that promote social welfare should primarily
promote the common good and general welfare of the
people of the community as a whole.
An organization that primarily benefits a private group of
citizens cannot qualify for IRC 501(c)(4) exempt status.
In Erie Endowment v. United States, 316 F.2d 151, 156 (2d Cir.
1963), the court, in defining a civic organization, summed up the
matter by stating that "the organization must be a community
movement designed to accomplish community ends."

So basically - as the statute was written and as it presently exists as law - an organization that is requesting tax exempt status under the 501(c)4 statute, which is what the crux of this Tea Party/Patriot "scandal" is purportedly all about, should be involved in activities that promote the common good and general welfare of the people of the community as a whole, AND, be performing these activities in a manner that does not benefit a private group of citizens and especially so if those citizens are involved in raising money on behalf of or promoting a specific political party or candidate.

Now - let us dissect this a bit further shall we?

The question may be asked dear reader - why would any group then, conservative or liberal, wish to have this coveted 501(c)4 tax status bestowed upon their organization?  Simply this:  the statue allows that these groups can raise unlimited amounts of money and are not required to publicly disclose where and from whom that money comes from.  Get it?  Secrecy -- it's like gold in the wretched world of American politics.

The Gadfly would ask the question - on the heels of Barack Hussein Obama's election to the Presidency, which undoubtedly was the catalyst for the sudden appearance and proliferation of the Tea Party and a myriad of other groups hijacking the word 'Patriot' for political purposes, along with the insidious Citizen's United decision by the SCOTUS that opened the floodgates to even more murky money in politics - is it really that much of a stretch of the imagination to think that the government agency tasked with ensuring compliance with tax law might want to take a closer look at the sudden, tremendous influx of tax exemption requests under the 501(c)4 statute from groups that had the names 'Tea Party' and 'Patriot' in their organization names? Are you fucking kidding?

Ultimately - just think about how stupid this conversation has become.  It is universally acknowledged, even by most sane Republicans, that groups who are engaged in active politicking on behalf of any political party or individual political candidates can, in no rational manner, be classified as a "community movement designed to accomplish community ends."

Get this shit -- a group created by and run by Karl Rove called Crossroads GPS applied for and received tax exempt status under the 501(c)4 statute.  The Gadfly will state this bluntly for anyone not within earshot -- Karl Fucking Rove is not, never has been, and never, ever, FUCKING EVER will be a community activist engaged in the noble endeavor of operating a "community movement designed to accomplish community ends."

Keep in mind also that the Tea Party has their own goddamn caucus in Congress for fuck sake! They are actively running political candidates as Tea Party candidates!  Why the fuck wouldn't the IRS scrutinize groups having the words 'Tea Party' in their name who are requesting special tax status?  The Gadfly would wholly expect the IRS to be skeptical of groups requesting tax exempt status who had the words 'Liberal' or "Democratic" in their names, and would certainly hope that the IRS rejected those requests if there was even a hint of partisan political activity in their dealings.

Be all that as it may - the ugly truth is that this country's campaign finance laws are a fucking corrupt, incomprehensible, unfair mess - as is our tax infrastructure.  Is it any grand wonder then that we have all of these right and left organizations, under the guise of promoting "community welfare", doing their self-serving political business on the taxpayer dime?  The Gadfly would say that the simplest solution is to just fucking get rid of all of these tax exempt loopholes altogether - in one fell swoop.  Then legislate a single unambiguous law which decrees that any group involved in any type of activity whatsoever on behalf of any political party or candidate pays a flat rate tax, no exceptions, on that activity -- period. PERIOD! Additionally -- every single goddamn one of these organizations should be mandated to account for how they spent every dollar, which political party and candidate(s) benefited, and provide an accurate yearly public domain listing of every single one of their individual and corporate donors so that every American can see who's money is having the greatest amount of influence in our political system.

But The Gadfly, and he suspects most of you dear readers would likely agree, knows that such a Sysyphean and dire undertaking is not going to come to pass in this country - unlikely in our life times anyhow.  So face it and accept it - our government, and by proxy our country, is corrupt.  Our political and corporate infrastructures are corrupt.  The people who are supposed to be ferreting out the truth and keeping we the people informed, our media, is hopelessly corrupt.  All of these entities feed endlessly off each other like maggots on a pile of cow dung.  But nobody wants to talk about it or do anything really meaningful about it. That would take courage, and integrity and hard work.  It is much effortless to just jump up and down, stamp your little feet, and bitch and moan about inconsequential bullshit like this IRS deal. Here's The Gadfly's rudimentary take on all of this tiresome crap -- the right wingers, whining like stuck pigs, were caught red-handed trying to slurp up a bit more than their share of taxpayer slop, and by their own actions then have outright invited ridicule such as the kind The Gadfly is heaping upon them this very moment in regard to this phony scandal. They deserve no sympathy - none - nada!

In summation - if the Tea Party crybabies (and The Gadfly was wondering btw - since when did these loser Teabaggers become such pouty, whiny little pussies anyhow?) were truly, and sincerely interested in setting things straight, in the public interest, with the IRS and in the government, they would be focusing on the much bigger picture of this anchored institutional corruption instead of the actions of a few overworked, dead-end-job hating civil servants, who basically when tasked with the additional duty of overseeing campaign finance law on top of their normal duties, were in essence tasked with shoveling shit out of the pig farm barnyard with a soup spoon.

Hey Right Wingers -- go find a real scandal with real world consequences to real world people to get overwrought about and maybe, just maybe, The Gadfly might lay off of the mockery of you assholes a bit.

Tea Party Congressman Stephen Fincher of Tennessee quoted a verse from Book of Thessalonians in defense of cuts to the Supplemental Nutrition Assistance Program, better known as food stamps. “The one who is unwilling to work shall not eat,” said Fincher during a House Agriculture Committee meeting for a markup of the Federal Agriculture Reform and Risk Management Act.
Approximately 45 percent of the beneficiaries of food stamps are children. While the bill he is voting for would cut food stamps for the neediest of Americans, Fincher himself is the recipient of major government assistance. The congressman has received over $3.5 million directly from the government in agriculture subsidies.

Head-Slapping, Moronic Bullshit Derpitude of the Day . . . .




It irks The Gadfly to an insufferable degree that a great many of these Republicans have about as much self-awareness as a rusty fucking doorknob.

Observe:

Mississippi Gov. Phil Bryant (R) said Tuesday that America’s educational troubles began when women began working outside the home in large numbers.
Bryant was participating in a Washington Post Live eventfocused on the importance of ensuring that children read well by the end of third grade. In response to a question about how America became “so mediocre” in regard to educational outcomes, he said:
"I think both parents started working. And the mom is in the work place."


The Gadfly cannot fathom that the thought has not dawned on the good Governor that perhaps 30 years (since the era of St. Reagan) of wage and cost of living wage adjustments being depressed, the coddling of corporations shipping U.S. jobs overseas, and economic policies that are heavily tilted in favor of the already wealthy and big corporations, and all supported by the free market fairy believing conservatives, has not contributed markedly to this deeply concerning conundrum of education suffering because dear mommy has to trudge off to work in order to help put food in her kid's bellys and keep the electricity on.

So blow me Governor.

Many more American families, the numbers increasing rapidly every year, are finding themselves in the untenable position of having to have both mom and dad as full-time wage earners simply to get by with providing their families with life's basic necessities from week to week.  

Where are the good paying jobs Governor?  Where are the livable wages Governor?  Where are the price controls on upward spiraling healthcare costs and basic necessities such as food, gas and utilities Governor?  Where is the legislation for an equitable, middle-class nurturing tax structure Governor?  Where are the programs to help struggling 2-wage earning families cope better with your conundrum Governor?   The Gadfly will tell you where all of these things are dear reader -- these things that would resolve the good Governor's education enigma -- they are in the minds of those dirty fucking hippie progressives who have been telling Governor Bryant and the rest of the conservatives in this country for decades that they were setting this country up for a massive and bitter failure of their beloved capitalistic economic ideology, which they wrongly perceive as infallible if only left to it's own unregulated designs.

So yeah - this kind of shit really does gall The Gadfly to his wit's end.  Thankfully The Gadfly has this shitty little blog to let off steam in - otherwise he would likely be out and about embroiling himself in all manner of depraved mischief - like sticking firecrackers in frogs sphincters and blowing them up - just like George W. Bush did as an agitated young fella.
